Hindi dapat maging isyu kung sino ang magsisilbing presiding officer dahil nakasalalay ang proseso sa umiiral na accountability mechanism ng Senado at hindi sa personalidad ng sinumang opisyal, ayon kay Batangas Rep. Gerville Luistro.
Binigyang-diin din ni Luistro na hindi dapat husgahan si Escudero batay sa mga pangyayaring may kaugnayan sa unang impeachment proceedings noong 19th Congress dahil magkaiba ang sitwasyon noon at ang kasalukuyang impeachment case.
