Kabilang sa mga isinampang kaso ng Bagong Alyansang Makabayan, Bayan Muna, Agham at Train Rides Netowrk laban kay Abaya at mga opisyal ng BURI ay graft at paglabag sa government procurement law.
Inakusahan ng mga militanteng grupo si Abaya at BURI officials nang panggagatas sa pamamagitan ng paggamit sa nasabing kontrata gayung milyon – milyong mga commuter ang nagsa – sakripisyo dahil sa araw – araw na aberya sa MRT – 3.
Binigyang – diin ng mga complainant na pumasok sa kontrata ang mga respondent kahit hindi kuwalipikado ang BURI na gawin ang nasabing proyekto.
Magugunitang Nobyembre 6 nang tapusin ng gobyerno ang maintenance contract ng BURI.
